Bank Charges
Anyone who wishes to make a claim for unfair charges will still have to go through the complaints procedure with their bank or building society. After this has been exhausted and you have a letter of deadlock in which the bank states you don't have a claim and will not refund you, you are free to contact the Financial Ombudsman.
The Financial Ombudsman has specifically said it will only look at bank charge complaints in 3 different scenarios
- You are in financial hardship

If you can prove you are struggling to meet your priority debts such as rent, mortgage, utility bills, council tax and you are now living off credit you are likely to qualify as being in financial hardship.
- Your charges are disproportionate

For example; you have dipped into your unauthorised overdraft by say £3.00 and find you are charged £35 for this, this would be utterly disproportionate. The Ombudsman may look at this, however if you do this regularly you are less likely to succeed.
- You have charges upon charges

If you find you are having charges upon charges and are never clearing your overdraft before new charges are added on, the Ombudsman should look at this too. The Banks or Building Societies should have already picked this up and be helping you with your debt and stop the cycle of charges upon charges.
